East Vincent Township Board of Supervisors' Meeting, Wednesday, September 2 at 7:30 P.M.

The East Vincent Township Board of Supervisors' Meeting is scheduled for this Wednesday, September 2 at 7:30 p.m. in the East Vincent Township Municipal Building located at 262 Ridge Road.

The Continuing Care Retirement Community (CCRC) Ordinance Amendment Proposal has gone through the proper advisory boards of the Chester County Planning Commission and the Phoenixville Regional Planning Commission. The transparent discussion about the recommendations from these Advisory Boards will now proceed to the Board of Supervisors.

Update: East Vincent Township Planning Commission Meeting, August 18, 2009

Last evening, a representative of the Springford Youth Athletic League presented a plan which demonstrated the lot line change welcomed by the Spring-Ford School District. This lot line change will allow the property already utilized by the Springford Youth Athletic League to be ceded to the Borough of Spring City. This ceding of the property to the Borough and SFYAL will allow for a driveway off Wall Street therefore eliminating the existing driveway to the fields and the issues which have transpired as a result of that existing driveway; such as speeding and dust which were affecting the properties situated near this entrance. April Barkasi, East Vincent Township Engineer stated that the presentation is not complete and the Planning Commission therefore could not approve the plan at this time. The representative also mentioned that SFYAL would like to put Musco Sport Lighting at the facility. He stated there are seven light posts which would be utilized and that these particular lights do not spill into neighboring areas. Vandalism at the SFYAL property was addressed and the league would like those who witness these acts to contact the local authorities. A Land Use Application would need to be completed before lighting can be addressed.

The Planning Commission received letters from the Phoenixville Regional Plan, the Chester County Regional Plan and from Jim McMaster, the attorney for the Phoenixville Regional Planning Commission about the proposed zoning ordinance for a continuing care retirement community (ccrc). Issues consistent with all of the advisory boards' recommendations, according to Planning Commission member Todd Bereda include concerns regarding the height of the building, how the building is situated, where the building is situated, density, etc.

Planning Commission member Lawson McCartney mentioned the Chester County Planning Commission concern about the risk to the township and what kind of precedent would be set by adopting this ordinance.

Jason Herron questioned if the "fee in lieu of taxes" agreement is enforceable. Ray Ott, East Vincent Township Planner said he's never personally seen this but it could be negotiated as part of the conditional use. It was also stated that the proposed zoning ordinance in question did not make mention of a one-time fee. Mr. Herron stated that unless there is an economic advantage to the township, there should be less density.

Elaine Milito expressed concerns about the density coming into the township. Dr. Milito stated that "East Vincent already has the assisted living facilities zoned in the township even though the component is not a specific ccrc amendment." She raised concerns as to why this proposed ordinance was never brought before the Planning Commission or why Ray Ott didn't present this to the Planning Commission. According to Mr. Bereda, this did not need to happen as the proper procedure was followed. Dr. Milito said the proposed ccrc amendment is not coming from a developer but from Ray Ott and Stu Cohen and these two need to address the concerns from the Phoenixville Regional Planning Commission and the Chester County Planning Commission. Dr. Milito suggested this proposed zoning ordinance be tabled, an analysis done and to craft it (the ccrc ordinance) to have the ccrc part of the Route 724 corridor where, in the event she were to move into this continuing care retirement community she would be able to walk, shop and go to nice restaurants because the ccrc is centrally located. Dr. Milito also suggested placing the ccrc in the PO and/or GI districts. These districts are located between West Bridge Street and Stoney Run Road and between Stoney Run Road and Route 724. Dr. Milito also said our township's buildout projection is now 376 units by 2030; much less than the published Phoenixville Regional Plan. Planner Ray Ott said the projected buildout (no. of homes/units to be built to maximum capacity in the township) is in the 1,000 unit projection and he did not know where the discrepancy comes from (1,096 to 376). He has not seen this new buildout projection.

Lester Schwartz also mentioned the recommendations from the Kise, Straw and Koldner, Inc., Urban Partners (KSK). KSK were responsible for providing data on the potential development for buildout in the region---including East Vincent Township. Dr. Schwartz stated there was a "lack of thought about not considering density changes from low to medium and from medium to high density." He stated that "we have low, medium and high density areas and we want to keep the low, medium and high density areas as they are presently in our zoning ordinance." With Dr. Schwartz having said this, The Informed East Vincent Residents would like to remind our fellow residents at this time that the reason this group formed was a direct result of the East Vincent Township Planning Commission---specifically Dr. Schwartz and Dr. Milito--- forwarding to the Board of Supervisors their approval of the Transfer of Development Rights/ Opens Space Design Option Ordinance Amendment proposal utilizing a Residential Density Multiplier (TDR/OSDO/RDM) on July 15, 2008. This TDR/OSDO Ordinance Amendment would have allowed a total buildout of 1,506 units---which included a 48% increase in residential development above and beyond what the Phoenixville Regional Plan (based upon KSK's data) and the Chester County Planning Commission recommended in our township. All of the major residential density would have been located north of the PECO power lines heading toward and beyond Rt. 724. Lester Schwartz and Elaine Milito both approved this motion allowing for an increase in density in order to create receiving areas for developers north of the power lines. Dr. Milito stated at the time that this residential density multiplier "would fix all our problems over the years." This TDR/OSDO Ordinance Amendment utilizing a Residential Density Multiplier would have impacted ALL taxpaying residents in our township, especially through higher school taxes, traffic, etc. Please refer to the August 6, 2008 post for more information.
The comments from the advisory boards and our Planning Commission will be forwarded to the Board of Supervisors where a transparent process in a possible zoning amendment change can occur.
The next Board of Supervisors' meeting is scheduled for Wednesday, September 2 at 7:30 p.m.
