In August of 2008, The Informed East Vincent Residents Group (IEVR) was formed. We, as a group of residents from both sides of the PECO power lines, came together out of concern about a proposed zoning amendment. This proposed amendment would have impacted our entire East Vincent Township community in many respects. Some IEVR members provided computer expertise, some used their human resource experience to pull the wording of the blog together, some provided insight into possible legal issues and others attended meetings.

Initially, many of us would do what we could to attend all the Planning Commission and Board of Supervisors' meetings. We would do our best to hold our appointed and elected officials to their promise of an open and transparent government. There were times when discussions between IEVR members and an appointed or elected official would get "heated." Still, even amongst threats of being thrown out of meetings and threatened with jail time; we remained committed to attending the meetings to assure transparency for the residents. Because I had the time available, and an understanding family willing to allow me to do that which was necessary, I became the resident responsible for attending all the meetings and sharing the the information about the meetings, on the blog.

As I attend the meetings, I've come to learn much lies ahead when it comes to future planning for our township. Therefore, I put in an application to be on our township's Planning Commission and I will begin to serve on the commission this month. The next Planning Commission meeting is Tuesday, March 16, 2010 at 7:00 p.m.

As a result of my appointment to the Planning Commission, our blog will no longer be active. The reason for this is because we believe it is unethical for an appointed or an elected official to maintain a blog. We believe it is unethical for an appointed or an elected official to utilize a blog, etc. for the purpose of sharing their own personal opinions and viewpoints about any issue which may be arising in the township. We feel that as an appointed or an elected official, one should be an impartial member of that committee/board, gather all information necessary to make an educated and informed decision--- in the best interest of the township, and only then share an opinion during the public format of the public meetings.

Update: East Vincent Planning Commission Meeting, January 19, 2010

Discussion last evening revolved largely around possible zoning changes. This discussion came about as a result of the workshop meeting between the Board of Supervisors and the Planning Commission which was held on December 14, 2009. The possibility of swapping the PO/GI (professional office and light industrial) districts to the Pennhurst Property, and moving the LR (light residential) district to the Jones Motor location, was initially suggested at this workshop meeting.

Ryan Costello, attorney for the Pennhurst Property owner, spoke to the Planning Commission (PC) about rezoning the Route 724 Corridor. He was requesting input and opinions from the PC about a possible rezoning; swapping the PO/GI district at Jones Motor, with the LR district of the Pennhurst site. Mr. Costello read the PO/GI ordinances and mentioned different uses allowed in this zoning. PC member Dr. Schwartz acknowledged that the "PO/GI district is a 'white elephant' due to it's size and is the largest of all the municipalities in the [Phoenixville Planning] region." He mentioned that "we [East Vincent Township] don't have to have a place for all of these uses," [PO/GI district]. Mr. Costello reminded the PC that the Phoenixville Regional Plan saw the PO/GI district in East Vincent Township as an incentive EVT had for the [Phoenixville] region. Dr. Schwartz would like to see mixed-use development at the Pennhurst site instead. He would like to see the light rail line come through as a means of transportation to and from the Pennhurst site. Dr. Schwartz commented that mixed-use development is very high in traffic and he didn't see the Jones Motor property and its surrounding roads capable of handling the traffic of a mixed-used development. Mr. Costello mentioned a cargo rail line that is in the Pennhurst area which could also be used to transport cargo to and from the Pennhurst site, therefore easing traffic concerns of a PO/GI use.

Mr. Costello suggested that if EVT were to allow for mixed-use on the Jones Motor site, the lands closer to West Bridge Street and Stoney Run Road could remain open space or used for farming---which would maintain the rural character of that area. If the zoning were to remain "as is", the Windgates and surrounding homes may eventually look out and see industrial use directly across from their developments. "A live, work and play" use at Jones Motor is the idea Mr. Costello was expressing.

Chairperson Adams commented that she would like to see Pennhurst as a mixed-use development and also suggested reducing the PO/GI tract along the Rt. 724 Corridor. Chairperson Adams would like to see an "Eagleview" type of development at the Pennhurst site. Mrs. Milito agreed with Chairperson Adams and Dr. Schwartz. Mrs. Milito would like to see the reduction of the PO/GI district so it doesn't have to go to Pennhurst. Mr. Costello mentioned that the PO/GI can be reduced at Pennhurst also.

PC member Lawson MacCartney stated that "our colleagues in Spring City don't want traffic to Pennhurst." PC Member Todd Bereda said "we need good uses to get people to stop in Spring City. If there is a good use at Pennhurst, this will give people a reason to stop." Spring City Borough Council Member, Jim Burns, mentioned that he lives off Church Street (one of the access point to the Pennhurst site) and he doesn't want to see the traffic. Dr. Schwartz said "we need a creative way of traffic flow".

Supervisor McNeil mentioned the Community Design Collaborative grant for the Pennhurst site. Mr. Costello is going to find out more about this.

The Planning Commission will host a working meeting with Mr. Costello, his client and the Spring City Borough, to continue to review the Rt. 724 Corridor and the possibility of rezoning.

Another issue regarding an amendment to the Open Space Design Option (OSDO) was discussed. Planner Ray Ott provided a document to the PC suggesting the reduction of the multiplier in the AP/RC (agricultural preservation and rural conservation) districts. Mr. Ott was scheduled to present his information but did not attend the meeting. Dr. Schwartz suggested reducing the multipliers more than Mr. Ott considered, or to get rid of the OSDO completely. He mentioned that the Phoenixville Regional Plan calls for East Vincent Township to have less density (number of homes). PC Member Bereda asked if the density is reduced in the AP/RC districts, how will this affect the LR, MR and HR (light, medium and high residential) districts? Will these districts have to increase density? Vice-Chair Herron had the same concern. Mrs. Milito suggested making a motion to approve Mr. Ott's cover letter which provided documentation regarding the the reduction of the multipliers in the AP/RC district. The rest of the PC did not want to take action due to questions pertaining to the information on the inside of Mr. Ott's document.

An amendment to the Open Space Map was approved by the Planning Commission and allows for more open space south of the PECO power lines. This particular open space addition to the map is located south of Rt. 23. This amendment to the Open Space Map will go to the Board of Supervisors.

The Planning Commission has no objections to the proposed amendment to the zoning ordinance in the Borough of Phoenixville. This proposed ordinance allows for a multi-residential district (townhouses) on a reduced tract of 5 acres. This proposal will now move forward to the Board of Supervisors.

The Board of Supervisors' meeting is scheduled for Wednesday, February 3, 2010 at 7:30 p.m.

Update: East Vincent Township Board of Supervisors' and Planning Commission Workshop Meeting

Last evening, Ordinance #203 was unanimously adopted by the East Vincent Township Board of Supervisors. This ordinance allows for commercial composting in light residential districts with 50 plus acres. Before the vote, Vice-Chair McNeil asked that the ordinance be changed from a 'by-right use' to a 'conditional use' so hours of operation, wastes included, liquid fuel travel and noise from the grinder can be regulated. Chairman Funk made it clear that Vice-Chair McNeil agreed to this amendment two weeks ago and she had personally attended all the Planning Commission Meetings and the Board of Supervisors' Public Hearing Meeting and she should have brought these issues up at those times. "Why the hold up?," asked Chairman Funk. Vice-Chair McNeil, said she wanted what was "agreed to verbally [at the mentioned meetings] to be put in writing." She wanted to "protect the residents near the facility." Supervisor Dunphy stated that there is a definition of composting and the Department of Environmental Protection (DEP) regulates the permits, etc. Supervisor Dunphy didn't want to see limits in terms of the hours certain activities, such as grinding, could be done because this could cause the facility to be in violation of it's own permit. As a farmer, he stated that "certain things have to be done and if you have to grind, you have to grind, to make sure the facility operates properly and within the DEP permit guidelines." A spokesperson for the composting operation said the facility will not be using a tub grinder but one that puts out 81 decibels when standing next to it as compared to the 90 decibels which comes from the tub grinder. The Informed East Vincent Residents were in attendance at all of the same Planning Commission meetings Vice-Chair McNeil attended. We heard most of the same issues Mrs. McNeil brought forth at this meeting addressed. These issues were discussed thoroughly and often. We also were in attendance at the Public Workshop held by the Board of Supervisors where Vice-Chair McNeil had the opportunity to bring forth the issue of 'by-right.' She did not make this suggestion at that time. Hours of operation, permitted wastes, etc. were all addressed at the Public Workshop and the Planning Commission meetings that Vice-Chair McNeil attended. IEVR were also in attendance at the last Board of Supervisors' meeting, two weeks ago, when Vice-Chair McNeil agreed to support the amendment as written.

During the workshop meeting between the Board of Supervisors and the Planning Commission several issues were addressed. The first issue brought forth was questioning how East Vincent Township (EVT) can become a walkable community with the Spring City Borough, The Spring City Borough is our urban center. The Planning Commission (PC) doesn't want to take away from the borough by building along Route 724. The PO (professional office/research/ industrial), GI (general industrial) and GC (general commercial) districts were areas to be studied. These districts are located along Route 724, West Bridge Street, Stoney Run Road and Mennonite Road. Does the township need such a large PO/GI/GC district? Another issue brought forth was what can be done about the Open Space Design Option (OSDO) which is encouraging growth in the Agricultural Preservation (AP) and Rural Conservation (RC) areas? The issue which involved the imbalance of having more sending areas (AP/RC) than receiving areas LR, MR, HR (light residential, medium residential and high residential), and the attempt to fix this by creating more receiving areas north of the PECO power lines, is another issue which needs to be addressed. Planning Commission Chairperson Adams said "There was a concern about sending development to one area and I sensed a division occurring in the township between north of the [PECO] power lines and south of the [PECO] power lines." PC Chairperson Adams is referring to the Transfer of Development Rights/ Open Space Design Option Ordinance Amendment (TDR/OSDO) utilizing a residential density multiplier, that was drawn up and close to approval back in September, 2008 (see post dated 9/18/08 for more information). Ms. Adams stated that "We need rural and open space on both sides of the township and that we should work with our partners in the borough and at Pennhurst when it comes to development." It was suggested that the density which could occur in the PO/GI/GC districts be moved to Pennhurst grounds. Ray Ott, EVT Planner has suggested that a 'mixed-use development' occur in the PO/GI/GC districts and this was put forth in the 'Route 724 Scope' the Planning Commission approved at their last meeting.

"No suburban sprawl along Route 724, walkable to Spring City Borough and commercialism of Route 724 is a mistake" were points certain Planning Commission and Board of Supervisors members seemed to be agreeing upon.

Discussion ensued about the use of Transfer of Development Rights(TDR). TDR's are used to send development to areas where development is deemed appropriate while saving lands in other parts of the township. Supervisor Dunphy stated that he has a "problem with the township being in the real estate business, feels the township should retire TDR's and feels there is a problem with the evaluation of the TDR's. Buying and selling of TDR's increases density in the township." EVT Planner Ott said TDR's have "never been very fluent with a simultaneous buyer and seller so this is why the municipality gets involved." Supervisor Dunphy also stated the "majority of open space money comes from taxpayers north of the [PECO] power lines yet the money is being used south of the [PECO] power lines." In other words, East Vincent taxpayers who reside north of the PECO power lines are putting .33% of their tax dollars to saving farms south of the PECO power lines and not in their backyard, where approximately 70% of the residents live. These PECO power lines can be seen intersecting West Bridge Street. Again, a small amount of open space money was used in administrative costs, etc., to acquire the park land at Pennhurst, given to the township by the owner of Pennhurst, as part of the agreement of sale with the State. Planning Commission Member Schwartz said he would like to retire TDR's. Dr. Schwartz also mentioned the fact that the PO/GI/GC [densities] are above what any other townships in the Phoenixville Regional Plan have and this is not what our township is about." Supervisor Dunphy suggested looking into studying and changing the PO/GI/GC districts.

Some final recommendations for the Planning Commission included eliminating the Open Space Design Option in the AP and RC districts. The Opens Space Design Option allows for clustering of the homes, and increased number of homes in a development, in order to leave open space surrounding the development. It was also recommended that there be a reduction and/or change concept to include mixed-use in the PO/GI/GC districts. The PO/GI/GC districts be considered for a use change (meaning instead of allowing for only offices or light industry=PO/GI/GC; allow for a combination of office and residential/walkable communities=mixed-use.) It was also suggested that the PO/GI/GC districts be moved to Pennhurst. Another option would be to get GI out of the Jones Motor area (if it is made residential) and that a GI use at Pennhurst would make more sense. Vice-Chair McNeil would like to see an "economic development analysis" before action is taken to move the PO/GI/GC districts. Vice-Chair McNeil would also like to see more 'green technology and sustainability' for future buildings and Chairman Funk would not like to see anymore single-family dwellings.

The last item the workshop focused on was the Continuing Care Retirement Community (CCRC) for the Ruth Tract (located on Stoney Run Road--- across from Kolb's Meats). The Planning Commission did not recommend the CCRC for the Ruth Tract. According to PC Chairperson Adams the reason for this is it's an "intense development in a rural area and unconnected to other uses." "It's isolated." Chairman Funk mentioned a client who has a CCRC called "Willow Valley," which is located in Lancaster and is isolated but has buses which take the people everywhere. Dr. Schwartz stated "it's out of context in the environment it's in." Chairman Funk mentioned the CCRC in West Vincent which is also isolated. He mentioned how the Ruth Tract CCRC isn't visible to most residents and how the township can get the developer to fix/expand the sewer plant so the taxpayer doesn't have to pay. Supervisor Dunphy said "We are close to maxing out of sewer capacity with the approved developments but we "don't build a sewer plant bigger than the need." PC Chairperson Adams stated "a developer sees a lot of EDU's (sewer capacity) and this 'sells' a township." Chairman Funk said a CCRC would not add more kids to the school district, residents don't drive and it's a tax base for the township." PC member Herron said he would like to make sure the "township money isn't invested in it and we end up with the CCRC flipping to non-profit and challenging the taxing. Make sure to get as much as we can upfront." Mrs. Milito expressed concern for the Stoney Run, Vice-Chair McNeil expressed concerns for lowering of property values and height of the potential CCRC above what our present ordinance allows. Supervisor Dunphy addressed the "isolation" of the Ruth location for a CCRC. He said "overseas I've seen seen communities built around these [CCRC] and the question is do we want to see it that way? It's phenomenal when it works; integrating a recreational component. Do we want to integrate, a possibility of having a nursery school, etc. to integrate?" The question is "Is this the right place for it?" Supervisor Dunphy also mentioned the needs of the landowner and he said the township has an obligation to look at the concept. Mrs. Milito said the "idea sounds great having these other things there" but she is concerned with the environmental placement. Supervisor Dunphy mentioned the abilities with the Latshaw tract; leave Latshaw open. He also made mention of the Camp Hill Models and if that's the direction for the township.

Reminder: East Vincent Board of Supervisors' and Planning Commission Workshop Meeting, Monday, December 14 at 7:00 P.M. Organic Composting Decision.

The East Vincent Township Board of Supervisors and Planning Commission will hold a workshop meeting this Monday, December 14 at 7:00 p.m. in the East Vincent Township Municipal Building located at 262 Ridge Road, Spring City.

This workshop meeting is being held to allow our Board of Supervisors, Planning Commission and Spring City Borough Council the opportunity for input and discussion pertaining to the Route 724 Corridor/Scope, possible zoning changes, Transfer of Development Rights issues and other possible land use issues.

The zoning amendment to allow for an organic composting facility on Pennhurst grounds, and future Light Residential Districts of 50 plus acres, is expected to be unanimously approved by the Board of Supervisors at this meeting. The East Vincent Township Planning Commission made a site visit to the Foley operation, found it acceptable and approved the ordinance amendment to go forward to the Board of Supervisors.

Update: East Vincent Township Board of Supervisors' Meeting, December 2, 2009. PennOrganics Composting Site to be Unanimously Approved.

Resolution #09-12-02-01-Final Adoption of the Phoenixville Regional Comprehensive Plan Consistency Review Report, was approved. Although East Vincent Township Supervisors Funk and Dunphy would like to see East Vincent Township removed from this regional plan, East Vincent must remain with the regional group for one year.
KSK, the planners for the Phoenixville Regional Plan, sent correspondence to the township in regard to a cost proposal for reviewing our zoning ordinance amendment. Supervisor Dunphy; who voted "No" to joining the Phoenixville Regional Plan in February 2008, asked the Phoenixville Regional Planning Commission (PRPC) members present at this meeting, "Who approved the proposal, who authorized KSK to do this?" Mr. Dunphy pointed out that the PRPC did not have their scheduled meeting but hired KSK to draft a proposal of opinions from the PRPC, who had yet to have their scheduled meeting. Supervisor Dunphy wanted to know who approved spending $1,000 on KSK to provide opinions on the zoning ordinance. None of the Phoenixville Regional Plan Committee members answered the question. Chairman Funk stated "It's clear somebody jumped the gun" in allowing KSK to provide recommendations. East Vincent Township Representatives didn't share with the PRPC or KSK the opinions of East Vincent Township for if they had there would have been no reason to hire KSK, as many of the issues addressed by KSK were brought to light at East Vincent Planning Commission meetings, Board of Supervisors' meetings and Public Hearings held in the township. Our township representatives to the Phoenixville Regional Planning Committee are Vice-Chair McNeil and Mrs. Elaine Milito. Clare Quinn, the West Vincent Township Supervisor and PRPC member explained the draft is drawn, goes to the PRPC for approval, disapproval, etc. "KSK develops, then PRPC discusses, as the Phoenixville Regional Planning Commission Members all have jobs, are supervisors, etc. and can't read through all the ordinances." Vice-Chair McNeil said she did bring forth the financial benefits, the developer in mind, etc. to the PRPC.

Chairman Funk had two suggestions for the PRPC: 1. Approve the CCRC text change since East Vincent Township zoning already allows for hospitals, nursing homes, schools, age-restricted community, etc in the LR, MR, and HR districts. The zoning ordinance was merely a "text" change and not really a "use" change. He noted that the PRPC members should know this [EVT Ordinances] so why they said "No" to this ordinance doesn't make any sense to him. Mr. Funk spoke directly to the PRPC member from East Pikeland and said "You have them why can't we? You have two gold geese with the CCRC's in your township." Mr. Strauss replied that "we have them in our growth zone" to which Mr. Funk reminded him about the zoning changes along Route 113. The second suggestion was to get rid of the PRP Planners KSK. Chairman Funk feels having planners who are unfamiliar with our area; such as KSK, don't know the area well enough to understand the needs of the area.

Clare Quinn said PRPC is an advisory group. Stu Cohen, township solicitor, challenged this and said "East Vincent Township can't adopt a change in zoning unless it gets approval [from the PRPC] or we withdraw (Article 17)." Vice-Chair McNeil said "If there is a dispute [between what the municipality wants and what the PRPC wants] we can go through a mediation process but can't adopt without the approval." It was pointed out that township representatives "don't vote in light of the municipality [the decision of the Board of Supervisors] but vote in light of the consistency of the Phoenixville Regional Plan. "Submerge individual municipal plans to the Phoenixville Regional Plan." In other words, the municipality seems to be conforming to the regional plans, and this includes, but is not limited to, assuring residential density zoning and growth areas, for example, are consistent with the Phoenixville Regional Plan and therefore not what is necessarily in the best interest of East Vincent Township (in the opinion of the Informed East Vincent Residents.)

In other matters, Vice-Chair McNeil again presented to Chairman Funk and Supervisor Dunphy a request of $4,500.00 in taxpayer dollars for the Master Plan with East Coventry for the Parkerford Tavern area. After lengthy discussion, Supervisor Dunphy voted "No" and stated "We already spent $35,000 on a Master Plan for the Parker Ford Tavern. Towpath Park is right down the road, has all the facilities and putting money toward this Master Plan during these tough times is redundant. If Towpath Park wasn't already there I would agree to this." Chairman Funk compromised, and agreed to add $5000.00 to the EVT Park and Recreation Budget, in January, for the possibility of getting the PECO Green Energy Grant to have a Master Plan developed.

The 2010 Proposed Budget was adopted and available for review and comment through December 14.

Chief Demski reported that the burglary suspect has been arrested. He also reported that the police budget is down 9%. This is a result of not purchasing a new vehicle (these are routinely replaced every year), the loss of an officer who has not been replaced and the loss of a part-time officer who is deploying for Afghanistan and will not be replaced. There has also been a cut in the operating budget; for example, training. A resident asked if this will affect the availability of officers for emergencies, etc. Chairman Funk responded that many townships don't have their own police force and rely on the State Police. The resident made it clear that he felt spending money on roofs and parks is not as important as spending the money on the security of the residents.

Ordinance #202-Amending Chapter 15, Part 4 General Parking Regulation. A Motion advertising a $25.00 fine for parking along cul-de-sacs and other emergency roads during snow events, therefore impeding the ability for the Roadmaster to clear the roads, was approved.
Resolution #09-12-02-05--Granting Conditional Preliminary and Final Land Development Plan Approval for the Southeastern Veterans Center Expansion, was approved.
All Resolutions for the Open Space Amendment and Acquisition of TDR's for the Shantz Property (located on Bethel Road), were approved.

Last evening, the Planning Commission (PC) forwarded to the Board of Supervisors a Motion Recommending Preliminary Final Land Development for the Southeastern Veteran's Center. The Motion was then amended to request that the Board of Supervisors consider any improvements, such as walking trails. The spokesperson for the veteran's center expressed security concerns with having walking trails on the property. He stated "Personally, I think it's a dangerous thing," when asked why walking trails are not included in the plan. The ability of staff to keep an eye on the veterans at all times was the main concern. Presently, out of 314 veterans, 20 are capable of leaving the grounds on their own. Also, the request from the Planning Commission for a Green Roof is not an option for this facility, according to the spokesperson. Two reasons were provided to the PC for this decision and were based upon the National Fire Safety Code; the function of the building and height of the building. The Department of Health, according to the spokesperson, does not approve Green Roofs on certain commercial facilities or long-term care facilities.

The Motion to Add The Schantz Farm Acquisition to the Open Space Map, was approved. The Schantz Farm is located on Bethel Road, south of Route 23, and is situated in both East Vincent and East Coventry.

The Route 724 Corridor Scope was discussed. Ray Ott, EVT Planner addressed the Transportation Aspect, Economic Development Aspect, Recreational Aspect and Zoning Aspect of the Scope. The issue on the table is how to seek funding to put the Route 724 Scope into action. Presently there's not a lot of money, a.k.a. grants, available. Dr. Schwartz would like to see how traffic can move better from East Vincent Township into Montgomery County without going through Spring City, addressed. Mr. Herron would like to see this Planning Commission take action instead of just talking about what they would like to see done with the Rt. 724 Corridor. He feels due to lack of action, grant opportunities are being missed. In response to Mr. Herron's statement, a Motion to Adopt the Route 724 Scope was approved by the PC. The Planning Commission will meet with the Board of Supervisors and the Spring City Borough to discuss and address issues in the Route 724 Scope on December 14, 2009 at 7:00 P.M. The public is welcome to attend this meeting but will not be permitted to have any input. (Please see the post dated 3-19-09 Update of Planning Commission Meeting to see why the Informed East Vincent Residents feel this is not what we were previously told.)

Mrs. Milito asked that the Planning Commission request the Board of Supervisors to rethink the Master Plan decision with East Coventry. Chairman Funk and Supervisor Dunphy both voted "no" to using more taxpayer dollars for another park plan at this time (see post dated November 5, 2009). This Master Plan would be for the Parker Ford Tavern Area. East Vincent Township taxpayers and East Coventry Township taxpayers would each put $4,500.00 toward a PECO Green Energy Grant to have a Master Plan drawn up for the area. Mrs. Milito also requested that the Planning Commission talk to the Board of Supervisors about pulling out of the Phoenixville Regional Plan (see post dated November 5, 2009 for more information). Chair Adams said we have to be in compliance with the Phoenixville Regional Plan for a year so this issue and the Master Plan issue can all be addressed at the workshop meeting scheduled for December 14. It was also noted that the process to remove East Vincent Township from the Phoenixville Regional Plan is in effect.

One resident asked the Planning Commission to define exactly where the Route 724 Corridor is located; Point A to Point B. Is it just the area directly along Route 724? Mr. Ott stated that the Rt. 724 Corridor keeps "getting bigger and bigger and includes land on both sides of Route 724 but also includes the PO, GI and GC Districts." These districts are located along Rt. 724, Stoney Run Road, West Bridge Street, and Mennonite Road. Also, the zoning of the PO, GI and GC districts may go from single-use zoning; such as office buildings, to a mixed-use zoning which includes a mix of commercial and residential properties. These Districts were also mentioned as slated for increased residential density for the transferring of development rights (TDR) at the last PC meeting.

Residents concerned about future land use plans conceptualized by the Route 724 Corridor Scope (which includes zoning and residential density changes) are strongly encouraged to attend the December 14 workshop meeting to learn firsthand what your elected and appointed officials would like to see happen right in your own backyard.

Update: East Vincent Township Board of Supervisors' Meeting, November 4, 2009

The proposed zoning amendment to allow for a composting facility was discussed at length last evening at the Public Hearing previous to the Board of Supervisors' meeting. Access roads to the facility include Church Street, Pennhurst and Brown Drive. James Burns of the Spring City Borough has "no objections to the organic composting operation at Pennhurst," but is concerned with commercial access and stated "the Borough could impose weight limits for trucks using Church Street to limit using this road as an access point." Todd Bereda of the East Vincent Township Planning Commission reiterated that the Planning Commissions' fears about this operation were alleviated upon a site visit to the Yost Organic Composting Operation. He also stated that he "appreciates each municipality having a voice but is concerned that a private business can be dictated to in regard to access. These are the same roadways the National Guard goes over; roadways we all pay for and that are state roads also." The size of the trucks coming in and out of the facility were described as landscaping-type vehicles and pick-up trucks. The organic composting operation would be closed on Sunday (unless there were an emergency such as downed trees) and would sell to local residents, landscapers and garden shops. The owner assured the Board that no animal carcasses will be allowed. Only yard waste (i.e. leaves, branches), pre-consumer waste (i.e. corn husks) and post-consumer waste ( i.e. bits of hamburger, fruits, etc.) would be permitted in the organic composting. The chipper would be used 5-6 1/2 times weekly. If the organic compost is not marketable the company is in violation of the DEP Permit and the product will have to be hauled away in a container. Any complaints to the DEP are responded to within one day and it's in the best interests of the organic compost company to operate this facility properly to produce a marketable product and assure there is no odor. If this amendment passes, other areas where an operation of this nature may occur include Armory Drive, the Solty's Tract and the Ruth Tract. Residents expressed concerns about traffic, the ability of vehicles to maneuver on these roads and concern for the safety of veterans who often walk to the CVS on these roads. A petition was turned over to the Board of Supervisors by those who are against this facility. One resident who lives in the area stated his support for the organic composting operation.

The Board approved the purchase of 25 transferable development rights (TDR) at 710 West Seven Stars Road at the cost of $817,300.00 Open Space dollars.
The Board also approved the purchase of 41 transfer of development rights (TDR) at the Schantz Farm located at Brownback's Church Road and Bethel Road for $1,047,796.00 Open Space dollars.
Transfer of Development Rights (TDR) are used to preserve land deemed worthy of saving in order to send development where deemed appropriate. All residents pay .33% of their tax dollars toward open space, presently all the open space monies have gone south of the PECO power lines with the exception of a tiny bit used in administrative costs when the State gave us the 82 acres at Pennhurst to EVT as part of the agreement of sale with the owner of Pennhurst.

East Vincent still has a surplus of $179,000.00 but we are down in revenue by $49,000.00. Township Manager Mary Flagg stated she "hopes we may come even by years end." Property assessments are coming down and therefore the tax revenue is also down. Chairman Funk stated the township may have to look into raising taxes, finding revenue sources and ask that the school district look at their budget ( a large portion of our tax dollars goes to the Owen J. Roberts School District).

The Approval to Advertise the Phoenixville Regional Planning Committee Final Consistency Review Report Acceptance was not approved. Chairman Funk made a motion directing our Township Solicitor to provide us with the necessary information needed to withdraw from the Phoenixville Regional Plan. Supervisor Dunphy seconded this motion. Chairman Funk stated his reasons as "the plan being more trouble than it's worth." He stated that "the Board voted for an amendment to our zoning and our representative (Vice-Chair McNeil) voted against the Boards' decision" (and therefore not in accordance with the Boards' decision). Supervisor Dunphy stated he agrees with regional planning but feels our township would be better served working within our school district and not Phoenixville and Great Valley's School Districts. He doesn't feel we should allow Phoenixville and Charlestown Townships to dictate our planning. He stated that "the TDR issue is complex and when you talk about any use in the township you have to keep in mind you can't do density without TDR's. This is not just about a CCRC issue." Vice-Chair McNeil said the only townships included in the Pottstown Regional Plan are East Coventry and North Coventry. She feels we've spent eight years on the Phoenixville Regional Plan and since it's in Chester County we should stay with it. She also said that the Phoenixville Regional Planning Commission is not against a CCRC in East Vincent Township but would like to see it in the mixed-use district. Vice-Chair McNeil also stated that regional TDR's may soon be an option. This means TDR's can transfer from one municipality to another. In other words, development can be sent from one township to the other. Presently, as one IEVR stated, East Vincent Township appears to have the most available mixed-use, commercial and industrial lands available in the entire Phoenixville Planning Region.
In regard to the CCRC issue, IEVR would like to remind the readers that the land known as the Latshaw tract is in a sending area for TDR's. Therefore, the owner of this land (who initially wanted a CCRC on the Latshaw tract---and Mrs. McNeil felt was a "worth looking into," and IEVR would like to stress that this area is in a sending area and the Stoney Run Watershed), can buy TDR's from the township if he so chooses and then send the development to a receiving area. The size of the development will depend on how many TDR's are available to the developer. Presently, East Vincent Township has not retired the TDR's but is "banking" them. Simply put, the more you have in the "bank," the more opportunity for development north of the PECO power lines where the receiving areas exist. Supervisor Dunphy has repeatedly stated he would like the Board of Supervisors' and Planning Commission to look at our zoning in a holistic way, along with the Rt. 724 Corridor and TDR's, to determine the best approach to development in our township. He would like our residents and appointed/elected officials to make this determination; not just an outside advisory board such as the Phoenixville Regional Plan.

Ms. Flagg stated that there is virtually no revenue from development in the long run; to educate costs more money than a homeowner pays in taxes to the township. Single-family homes raise costs and raise taxes. The question is how can East Vincent Township mitigate the contribution to the Owen J. Roberts School District (for the taxpayer)?

A resident from West Bridge Street requested that the Board "look at all the unintended consequences of certain development and make sure the Township gets the type of revenue it's looking for."

Chairman Funk and Supervisor Dunphy voted "no" to spending $4,500 of taxpayer dollars for a Master Plan with East Coventry for the Schuylkill River Heritage Trail area. Vice-Chair McNeil feels we can get a PECO Green Energy Grant to offset costs. Chairman Funk feels the County should take the lead in this and Supervisor Dunphy stated that "we already have our hands full. We have the Reiff Park to plan for, and the 82 acres at Pennhurst to plan for, so let's finish what we have before spending more money on another plan."

The request for $1,000 donation to French and Pickering Creek is under advisement at this time.

Chief Demski reported there were two burglaries in the area; one in Barton Meadows and another on Brownback's Church Road. It's possible these homes were targeted specifically. The suspect is known but has not been found. In a separate incident, a burglar who broke into a home on Clover Hill Road, was caught.

During Public Comment, one resident mentioned that the Memorial at Pennhurst looks nice. He also asked what kind of camera was used to take the photos of the restoration of the Parkerford Tavern. He felt the cost of the pictures at $1,100 was a lot of money for what the Township received.

Update: Board of Supervisors' Meeting October 7, 2009

At the last Board of Supervisors' meeting, a Keen Road resident thanked the Board for repairing her road but questioned why the oil and chip method was used. Vice-Chair McNeil stated that "we receive a small amount of money from the state and oil and chip is used to extend the life of the road. It's common practice to oil and chip. It's the best that can be done with the measly allocation given."

The Informed East Vincent Residents would like to note at this time that we have received information that the Parker Ford Tavern Roof project is $39,391.56 over the original estimated project budget. This brings the total cost of the roof and cornice restoration project for the tavern and its kitchen wing to a grand total of $245,426.56. The explanation for these additional costs include tree removal, additional administrative costs not conveyed in the report we received and the two change orders to rebuild the west chimney and repair framing approved by Chairman Funk and Vice-Chair McNeil. Preservation of the Parkerford Tavern is a worthy cause and one that is consistent with our Township's Comprehensive Plan, but, quality road repair would also seem to be a worthwhile use of taxpayer dollars also.

Chief Demski noted that serious crimes are down, however, Honda vehicles have become the target of thieves so please remember to lock up your vehicle---especially Hondas.

Vice-Chair McNeil said the Northern Federation, which is made up of 9 municipalities, will be sending a regional survey to all households. The results should be out in the later part of this year.

Ordinance 200, Chapter 15, Part 2 15-201 amending Code regarding maximum speed limits and stop intersections, was approved. Signs have been put up on Old Schuylkill Road and Brown Drive, a yield sign at Reitnoir Road and Stoney Run Development has a three-way stop sign so families can safely walk to the playground. Pikeland Avenue now has the ordinance to enforce the speed limit.

Saul Rivkin of the Historic Commission spoke about the Historic Inventory Plan. He said Phase I of the plan would be to make contact with residents who have historic properties and create a file for each property. Supervisor Dunphy asked what Phase II would entail? Mr. Dunphy said "homeowners would like to know what you're going to do with this data." Mr. Rivkin said the "objective is not to dictate (to historic home owners)." Supervisor Dunphy, who lives in an historic home himself, offered to share data with the Historical Commission about his home. Mr. Rivkin also mentioned an upcoming program called "What is Historic Preservation?" This is to be a free event open to the public and will be announced. The Informed East Vincent Residents recall a past historic preservation open house which focused on rallying support to Preserve Pennhurst. Mr. Rivkin assured the residents last year (who expressed concern about the cost of last year's Open House and Art Exhibit and who were in attendance at the following Board of Supervisors' meeting in Oct. 2008), that all the food and beverages were donated by the Historical Commission and taxpayer dollars were not used (above what the commission has in it's allocated budget). He said he donated cookies, Elaine Husted donated brownies and lemonade, and so on. The IEVR however have documentation showing requests for reimbursement by Mr. Rivkin, Mrs. Husted and others to get their personal monies back for these "donated" refreshments and advertising costs. The East Vincent Taxpayer did provide the food, drink and advertising for the Open House and Art Exhibit dated September 12, 2008, held at the Ridge Fire Company, whether it was in the budget or not. Why say items were donated if you then ask the taxpayer to give you the money back?

East Vincent Township, utilizing the Open Space Bond Referendum and purchasing 25 (out of 26) Transfer of Development Rights, bought the Rodriguez Property, located on Seven Stars Road, for $817,300. This property is now reserved for open space and is forever deed restricted. Since this property is not on the present open space map, the acquisition will go to the Planning Commission then to the Board of Supervisors for a Public Hearing in November. A Windgate resident, commenting on Vice-Chair McNeil's comment that TDR's can be "retired, returned, held, etc." asked why the Township isn't just retiring the TDR's (and therefore limiting development). Township Solicitor Cohen said the Township is not required to. The TDR's can transfer to receiving areas (which in north of the PECO lines). Taxes paid to purchase Open Space and TDR's are not limiting development but are transferring development; such as with the Reiff Tract case." The Informed East Vincent Residents would like to note that ALL of our residents pay taxes toward the Open Space Bond Referendum, yet, if you live north of the PECO lines, only receiving areas for TDR's exist, so there will be no open space money used north of the PECO lines to preserve open space. Keep in mind too the Transfer of Development Rights/Open Space Design Option utilizing the Bonus Residential Density Multiplier Ordinance Amendment. This TDR/OSDO/ RDM Ordinance Amendment is meant to CREATE receiving areas north of the PECO lines so to increase density north of the PECO lines and preserve property in other areas of the township. This presently tabled Ordinance Amendment was approved to go forward to the Board of Supervisors (for approval) by Planning Commission members Lester Schwartz and Elaine Milito (Planning Commission Meeting Minutes of July 15, 2008). Also see the post on this blog dated August 6, 2008. The impact of this Ordinance Amendment will be felt both north and south of the power lines through higher school taxes, traffic increase, etc.

One West Bridge Street resident asked that a meeting be held with the Board of Supervisors and the Planning Commission to discuss a potential site for the Continuing Care Retirement Community (CCRC). This may be brought up at the next Planning Commission meeting on October 20. Another resident spoke of her concerns with speeding on West Bridge Street.

Supervisor Dunphy would like to look at the CCRC Ordinance, Zoning and the Route 724 Corridor in a holistic way. He would like the Planning Commission and Board to look at the big picture. He would also like to see the PO and GI districts (located on West Bridge Street, Stoney Run Road and Route 724) addressed. Vice-Chair McNeil stated that the current CCRC Ordinance, which is located in the Light Residential District and NORTH of the PECO lines, is "out of the growth zone". IEVR recall last year when Mrs. McNeil felt a CCRC on the Latshaw property was worth looking into. The Latshaw property is in the Stoney Run Watershed, south of the PECO lines and in the Rural Conservation District.

Residents located near the SFYAL ball fields asked about the status of the road closure near their homes. Vice-Chair McNeil addressed EVT Manager Ms. Flagg about what has been done. Ms. Flagg redirected the question back to Mrs. McNeil as Mrs. McNeil has been personally dealing with Scott Smiley of the SFYAL. Vice-Chair McNeil didn't address the comment other than to say she is allowed to speak with residents. Mr. Smiley is not a resident of East Vincent Township and yet EVT (Ms. Flagg and April Baraski, our township engineer) has bent over backwards to help him accomplish the goal of getting the lot line change and a driveway waiver. The impression IEVR's get is that Vice-Chair McNeil began to personally deal with Mr. Smiley during all of this and therefore there were "too many cooks in the kitchen", so to speak. Jim Burns of the Spring City Planning Commission stated that Spring City was committed to dealing with this issue. Supervisor Dunphy restated that "if this issue isn't addressed by next season, there will be no ball. It's time for the adults to step up to the plate and get this resolved." Mr. Dunphy mentioned safety issues of having almost 400 cars coming and going with only one way out. He wants the East Vincent Manager, Spring City Manager and Spring-Ford School District to address this situation and for everyone else to sit back and let these three do their job. Other issues revolving around this area involve homeowners pulling out the no parking signs and police jurisdiction at the ball field as a father and son who live near the ball field were verbally assaulted.

A resident also asked what can be done about an abandoned property on Broad and New Street. Ms. Flagg will address this.

Saul Rivkin asked if there is a procedure to cancellation of meetings. Solicitor Cohen said "no." The property owner made the request for the meeting, paid for it and had to cancel.

As a result of a threatening letter from Elaine Milito's solicitor, John S. Carnes, Jr., the Informed East Vincent Residents Group is being told to amend the statement "Elaine Milito spent CCOEV's money on Elaine Husted's campaign," and state that "no CCOEV money was used by Elaine Milito on Elaine Husted's campaign," (although we do not have documentation proving this statement). According to Solicitor Carnes, Jr., Elaine Milito used her own personal money to host the website for her opponent Elaine Husted during the primary campaign and CCOEV is only listed as the registrant because Elaine Milito "inadvertently failed" (her attorney's words-not ours) to remove the CCOEV reference. Please note Elaine Milito (D) ADMITS to using her own personal money to host the website for her opponent Elaine Husted (R) in the primary. Elaine Husted is now Elaine Milito's treasurer in the present campaign. Christine McNeil is listed as the Chair of Elaine Milito's campaign.

Solicitor Carnes, Jr. states in his letter "most importantly, no CCOEV funds have been used for this hosting site or any domain names, a fact that can be proven." We challenge Solicitor Carnes, Jr. and Elaine Milito to provide us with a listing of CCOEV expenses from the last two years. PROVE to us that no CCOEV money was used--- as you have stated.
Attorney Carnes, Jr. has warned the Informed East Vincent Residents not to make any "false and defamatory statements regarding the use of CCOEV funds for political purposes." The undeniable registrant for the domain site is CCOEV. The IEVR group is not responsible for Elaine Milito's "inadvertent failure" to remove the CCOEV as the registrant, not just one time, or two times, but a total of three times.
Elaine Milito's "inadvertent failure" brings into question her ability to lead. If Mrs. Milito is incapable of changing the registrant name for the account, three different times, what makes her capable of making decisions for our residents and our township? Who will she blame when she "inadvertently fails" again? Will contacting another solicitor be part of her plan? Also, as a result of her "inadvertent failure" to remove the CCOEV registrant information, is it possible that CCOEV ends up in litigation of it's own due to this "inadvertent failure?" Finally, one should question Elaine Milito's choice for solicitor to represent her. John S. Carnes, Jr., as Coatesville's solicitor, attempted to use eminent domain to take away a family farm. Elaine Milito seems to be the champion of saving land. Why would she hire an attorney who fought to take private land away from a family for public use? Why would Elaine Milito condone increasing our own township residential build-out 48 % (in the least) above and beyond what all the advisory boards (Phoenixville Regional Plan and Chester County Planning Commission) suggest and all north of the power lines only (see Aug. 6,2008 blog post)?

Might we suggest that Elaine Milito invest her time and energy sharing with the residents of our township what she has planned for us? What can she do for the residents of East Vincent Township other than investing her energy and time threatening a local resident and group who merely reported on a document on which SHE and her attorney admit she made a "mistake."

Based upon Solicitor Carne's, Jr. representation for Elaine Milito, we have made amends to the statement as noted above, however, we will continue to inform our residents about vital issues affecting our township. We will not be bullied. We feel this letter from Elaine Milito's Democrat Party solicitor is meant to stop political discussion and silence any dissenting viewpoints other residents may have. Again, The IEVR group is made up of Democrats, Republicans and Independents who came together to stop the Residential Bonus Density Multiplier. We have continued to attend meetings so that our residents can have a voice in decisions made in this township; decisions made by our elected and appointed officials. This blog will continue to present facts and allow our readers to draw their own conclusions and won't be silenced by threatening letters.

Update: East Vincent Township Planning Commission Meeting, August 18, 2009

Last evening, a representative of the Springford Youth Athletic League presented a plan which demonstrated the lot line change welcomed by the Spring-Ford School District. This lot line change will allow the property already utilized by the Springford Youth Athletic League to be ceded to the Borough of Spring City. This ceding of the property to the Borough and SFYAL will allow for a driveway off Wall Street therefore eliminating the existing driveway to the fields and the issues which have transpired as a result of that existing driveway; such as speeding and dust which were affecting the properties situated near this entrance. April Barkasi, East Vincent Township Engineer stated that the presentation is not complete and the Planning Commission therefore could not approve the plan at this time. The representative also mentioned that SFYAL would like to put Musco Sport Lighting at the facility. He stated there are seven light posts which would be utilized and that these particular lights do not spill into neighboring areas. Vandalism at the SFYAL property was addressed and the league would like those who witness these acts to contact the local authorities. A Land Use Application would need to be completed before lighting can be addressed.

The Planning Commission received letters from the Phoenixville Regional Plan, the Chester County Regional Plan and from Jim McMaster, the attorney for the Phoenixville Regional Planning Commission about the proposed zoning ordinance for a continuing care retirement community (ccrc). Issues consistent with all of the advisory boards' recommendations, according to Planning Commission member Todd Bereda include concerns regarding the height of the building, how the building is situated, where the building is situated, density, etc.

Planning Commission member Lawson McCartney mentioned the Chester County Planning Commission concern about the risk to the township and what kind of precedent would be set by adopting this ordinance.

Jason Herron questioned if the "fee in lieu of taxes" agreement is enforceable. Ray Ott, East Vincent Township Planner said he's never personally seen this but it could be negotiated as part of the conditional use. It was also stated that the proposed zoning ordinance in question did not make mention of a one-time fee. Mr. Herron stated that unless there is an economic advantage to the township, there should be less density.

Elaine Milito expressed concerns about the density coming into the township. Dr. Milito stated that "East Vincent already has the assisted living facilities zoned in the township even though the component is not a specific ccrc amendment." She raised concerns as to why this proposed ordinance was never brought before the Planning Commission or why Ray Ott didn't present this to the Planning Commission. According to Mr. Bereda, this did not need to happen as the proper procedure was followed. Dr. Milito said the proposed ccrc amendment is not coming from a developer but from Ray Ott and Stu Cohen and these two need to address the concerns from the Phoenixville Regional Planning Commission and the Chester County Planning Commission. Dr. Milito suggested this proposed zoning ordinance be tabled, an analysis done and to craft it (the ccrc ordinance) to have the ccrc part of the Route 724 corridor where, in the event she were to move into this continuing care retirement community she would be able to walk, shop and go to nice restaurants because the ccrc is centrally located. Dr. Milito also suggested placing the ccrc in the PO and/or GI districts. These districts are located between West Bridge Street and Stoney Run Road and between Stoney Run Road and Route 724. Dr. Milito also said our township's buildout projection is now 376 units by 2030; much less than the published Phoenixville Regional Plan. Planner Ray Ott said the projected buildout (no. of homes/units to be built to maximum capacity in the township) is in the 1,000 unit projection and he did not know where the discrepancy comes from (1,096 to 376). He has not seen this new buildout projection.

Lester Schwartz also mentioned the recommendations from the Kise, Straw and Koldner, Inc., Urban Partners (KSK). KSK were responsible for providing data on the potential development for buildout in the region---including East Vincent Township. Dr. Schwartz stated there was a "lack of thought about not considering density changes from low to medium and from medium to high density." He stated that "we have low, medium and high density areas and we want to keep the low, medium and high density areas as they are presently in our zoning ordinance." With Dr. Schwartz having said this, The Informed East Vincent Residents would like to remind our fellow residents at this time that the reason this group formed was a direct result of the East Vincent Township Planning Commission---specifically Dr. Schwartz and Dr. Milito--- forwarding to the Board of Supervisors their approval of the Transfer of Development Rights/ Opens Space Design Option Ordinance Amendment proposal utilizing a Residential Density Multiplier (TDR/OSDO/RDM) on July 15, 2008. This TDR/OSDO Ordinance Amendment would have allowed a total buildout of 1,506 units---which included a 48% increase in residential development above and beyond what the Phoenixville Regional Plan (based upon KSK's data) and the Chester County Planning Commission recommended in our township. All of the major residential density would have been located north of the PECO power lines heading toward and beyond Rt. 724. Lester Schwartz and Elaine Milito both approved this motion allowing for an increase in density in order to create receiving areas for developers north of the power lines. Dr. Milito stated at the time that this residential density multiplier "would fix all our problems over the years." This TDR/OSDO Ordinance Amendment utilizing a Residential Density Multiplier would have impacted ALL taxpaying residents in our township, especially through higher school taxes, traffic, etc. Please refer to the August 6, 2008 post for more information.
The comments from the advisory boards and our Planning Commission will be forwarded to the Board of Supervisors where a transparent process in a possible zoning amendment change can occur.

Update: East Vincent Township Planning Commission Meeting July 21, 2009

Last evening, at the East Vincent Township Planning Commission Meeting, two proposed zoning amendments were discussed.

The proposed zoning amendment for the organic composting operation, which is to be situated on the Pennhurst grounds, was approved by all Planning Commission members present. The approved proposed zoning amendment clarified that the operational hours for this composting site will be from 7 a.m. to 6 p.m., limits materials allowed in the compost and the setback issues which were of concern were addressed. The Planning Commission members all felt the on-site visit to the Yost Composting Facility was enlightening and eradicated some of their concerns. Traffic and access to the site are issues that remain. Planning Commission Members Elaine Milito and Lawson McCartney were not present.

The second proposed zoning amendment was for the continuing care retirement center (CCRC). Presently, East Vincent Township does not address this use in the zoning ordinance and this leaves the township open to liability. This proposed zoning amendment is not an application to build a CCRC, but is about a zoning change to allow for conditional use of the property. Conditional Use allows East Vincent Township Supervisors to put conditions on the developer; including such items as aesthetics, density, etc. instead of the developer having free reign to do as he chooses. April Barkasi, our township engineer, addressed the concerns of residents that this proposed zoning amendment could open doors for other CCRCs in the township. Ms. Barkasi stated that under the existing zoning ordinance an Applicant can come in and propose this CCRC anywhere in the township; location can't be restricted. " 'Forced action vs. planned action' (which includes conditional use) is the goal of this proposed zoning amendment. The door is gaping open right now." Chairman Funk and Supervisor Dunphy, by voting to approve the proposed zoning amendment to move forward to the proper advisory boards (East Vincent Planning Commission, Chester County Planning Commission and the Phoenixville Regional Planning Commission), are taking a proactive stance when it comes to future development in our township as opposed to a reactive stance in which the township is vulnerable to developer demands.
One resident asked about the potential value and benefit to the township of having a CCRC in the community. Potential revenues is one. Meeting the requests of the elderly who have lived here and who would like to see the township provide something for them as they grow older so that they could stay near their family and friends, is another.
Another issue brought forth by residents included the multi-municipality plan (Phoenixville Regional Plan) and whether East Vincent Township is required to have a CCRC if there are others in the region? Ray Ott, our township planner, will be asked to address this question. Residents' concerns included traffic, size and height of the building, the depletion of the rural character in their neighborhood and the density allowed in this proposed zoning amendment as the property is zoned light-residential.
Another resident suggested that Pennhurst would be the ideal location for a CCRC of this size. He mentioned roads can be redone, viable business can be created, this facility can be showcased in this area, etc. The resident was told that the Pennhurst grounds, which are also zoned light-residential, is presently owned by a private party. A resident associated with Phoenixville Community Homes mentioned how this organization provides affordable housing and affordable senior housing (like The Bard House and The Flag House) and he felt this affordable housing could be situated in Pennhurst. Another resident suggested moving the CCRC to the PO district. The PO district is located right around the corner from the Ruth Tract and many of the same issues will be prevalent with the exception that the building will no longer be directly in this resident's view.
The resident associated with Phoenixville Community Homes insisted on getting a date certain in regard to the decision of the Planning Commission and the proposed zoning amendment. He was told since there is no scheduled Board of Supervisors' meeting for August, the Planning Commission has more leeway to review this proposed zoning amendment and may take up to 60 days to provide it's decision.
Finally, a resident who is in favor of a CCRC in our township spoke out about how she would like to stay in familiar surroundings when she, at some point, may need a facility such as this. She has lived in this area her whole life and doesn't want to leave. She respectfully asked that residents opposing a facility for the elderly stop and think about those who may need one and who would like to stay in their neighborhood. One resident, noticing all the whispering and snide remarks being made by some who oppose the CCRC in their backyard, asked that people refrain from whispering while others are speaking as it's a rude thing to do.

Update: East Vincent Township Board of Supervisors' Meeting, July 1, 2009

At the July 1st East Vincent Township Board of Supervisors' Meeting, Chairman John Funk and Supervisor Mark Dunphy approved the proposed zoning amendment which allowed Mr. Paul Bucco's Continuing Care Retirement Community (CCRC) to move forward to the Planning Commission. Vice-Chair McNeil voted "no." The location of this CCRC is being considered for the Ruth Tract which is located on Stoney Run Road across for Kolb's Meats. Originally, Mr. Bucco wanted to build this CCRC on the Latshaw Tract which is located on West Bridge Street. The Latshaw Tract is in the Stoney Run Watershed. Last year, Chairman Funk and Vice-Chair McNeil felt the CCRC on the Latshaw Tract (West Bridge Street) would be worth considering after Mr. Bucco had downsized the buildings from several 6-7 foot story buildings to 2-3 foot story buildings spread throughout the tract. Mr. Ryan Costello presented information to the Board of Supervisors regarding the organic composting facility proposed for a portion of the Pennhurst grounds. The Board listened and made requests for information; including that the operational hours be added to the request for the proposed zoning amendment.

East Vincent Township congratulated Township Solicitor, Stu Cohen on 30 years of service to our township. Residents who came out to celebrate included Don Francis, Everett Wilson, Dick Mull, Clyde Sheib and others who thanked Mr. Cohen for his dedicated service to our community. Thank you Stu!

A resident from the Stoney Run Farms Subdivision asked the Board when the driveway to the ball fields used by the Spring-Ford Youth Athletic League will be completed. The Board let the resident know that they are aware of the situation and have been told that the school district wants the lot line changed first.

The 4th of July ceremony at the Revolutionary Soldiers Cemetery was a success. Thank you to the Historical Commission, and especially Mr. Clyde Sheib, for having this event in celebration of our nation's Independence!

Update: East Vincent Township Board of Supervisors' Meeting June 3, 2009

During last evenings Board of Supervisors' meeting, Chief Demski reported that serious crimes in our township are down approximately 50%. He attributes some of the decline in the arrest rate a result of less activity at the Pennhurst property. Chief Demski also asked our Board of Supervisors to review the traffic study recommendations recently conducted in East Vincent Township and allow for an amendment to Ordinance 15-Motor Vehicles and Traffic based upon these recommendations. Chief Demski and other East Vincent Township police officers studied the areas of Pikeland Avenue, the Parkview Residence intersection, Old Schuylkill Road and Brown Road, Pennhurst Road and Marion Drive, West Bridge Street and Stoney Run Road and the curve on Nottingham Drive. Chief Demski provided the Board with a traffic study review of these areas, along with a list of recommendations utilizing PennDot and the Local Technical Assistance Program (LTAP) guidelines to help remedy some of the traffic issues in those areas.

The proposed zoning amendment for the Continuing Care Retirement Community (CCRC) is "slowly grinding forward" according to Chairman John Funk. Chairman Funk said he is waiting for information from our consultants.

Vice-Chair Christine McNeil, who is also the Vice-Chair of the Northern Federation, spoke about the Northern Federation Plan. She made note that the May 9, 2007 Open Space Recreation Plan Update---specifically page 13 regarding park lands, had an inaccuracy that she would like fixed before this plan is sent to the Northern Federation members. Attorney Stu Cohen stated East Vincent Township did amend the Pennhurst grounds information on the map. Mr. Cohen suggested that the amended map be placed in front of the present Open Space Recreation Plan Update being sent to the Northern Federation. Mrs. McNeil also stated that the Reiff Tract Park information of this Open Space Recreation Plan Update was accurate. The Informed East Vincent Residents note there is no access to this "park" which was purchased utilizing taxpayer dollars.

Vice-Chair McNeil would also like East Vincent Township Planner Ray Ott to create a formula to determine the "fair market value of required recommended parkland." Chairman Funk commented that the value would be different for everyone---such as when land is contributed in developments. Supervisor Mark Dunphy's concern was that according to the Phoenixville Regional Plan, East Vincent Township has met its parkland requirements through 2025. Supervisor Dunphy asked why would we be looking to provide additional money for the Open Space Recreation Plan Update by paying East Vincent Township Planner Ray Ott to create a formula? Supervisor Dunphy stated that the Board should sit back and wait and see what the Northern Federation says instead of doing this independent of the Northern Federation.

Residents representing Stoney Run Farms addressed the Board of Supervisors regarding the continuing problems of dust, traffic congestion and traffic speed along the access road to the ball fields behind their homes. These residents have addressed East Vincent Township Board of Supervisors on several occasions and they would like to know the status of what is being done to control the speed of drivers, etc. entering the ball fields. These ball fields are located behind Spring City Elementary School. Vice-Chair McNeil feels there is a capacity issue at the sight and that we need to look at what other lands can be used for ball fields. Chairman Funk said we need to speak to the Spring-Ford Youth Athletic League (SFYAL) about capacity at some point. Supervisor Dunphy asked a resident what the capacity looked like now. The resident stated that there are approximately 300 cars with lots filled and cars parked on the street all trying to park to use the 6 ball fields. Another resident spoke about safety concerns in regard to the speed of cars entering and exiting the fields. He stated there are "way too many cars travelling way too fast." Chairman Funk suggested a meeting with the SFYAL and the Spring City Borough Council. Mr. Cohen, Esq., mentioned that Spring City controls the lease and this issue with traffic and dust can be considered a "public nuisance." Supervisor Dunphy asked what the time frame is for this to be done (possible lot line revision by Spring-ford School District and the SFYAL to get prices for new recommendations-i.e. fence, etc.). "Not this season" replied Township Manager Mary Flagg. Supervisor Dunphy suggested that "if this issue isn't rectified into next year's season then there should be no ball. Put a timeline on it or no ball." A Spring City Borough Councilman was in the audience and is well aware of the situation.

Supervisor Dunphy asked Vice-Chair McNeil for an update to the financial situation regarding the Northern Federation. Mrs. McNeil stated that one township had an issue but the $1,000 check is being processed. One resident asked which township had an issue and had not yet provided the money? Vice-Chair McNeil, who is also the Vice-Chair of the Northern Federation, could not remember.

John Hoekstra who is an East Vincent Environmental Advisory Council member and Green Valleys Association (GVA) member mentioned that GVA had received monies to complete a watershed assessment of the Stoney Run. Mr. Hoekstra hopes to gain, at a minimum, a recommendation as to what can be done to again designate the Stoney Run as a high quality creek.

Landscapes 2 has been adjusted to include The Schuylkill River National Heritage Area.

The Parker Ford Tavern project is again receiving taxpayer money to the tune of an additional $1,260 to repair rotted joists. Several residents spoke up against more use of taxpayer dollars for this renovation. One resident reminded Chairman Funk that again he went against his word of not using anymore taxpayer dollars for this project. Mr. Funk stated that when he said that he had "misstated." Supervisor Dunphy asked if we can some day have 1) projected date for project completion and 2) how close are we to hitting the budget? One resident asked how much money we have spent so far on the completion of 1/3 of the rafters? Chairman Funk asked if the Board could hold off on answering that question until the next meeting.

Update: Planning Commission and Board of Supervisors' Meetings, May 2009

This week both the East Vincent Township Planning Commission and the East Vincent Board of Supervisors' meetings were held.
A proposed zoning amendment was presented for the Pennhurst property. The proposed amendment would allow an organic composting operation on Pennhurst grounds presently zoned Light Residential. The Applicant is requesting an amendment to allow for the composting of organic material on the site. Residents located near the proposed site expressed concerns regarding animal products being brought to the site for composting, odor, traffic speed, size and amount of vehicles coming and going from the compost site, operation hours, possible health hazards, the impact on the veterans residing at the Veteran's center, the possible implications for other Light Residential areas having 50 acres or more becoming another site for composting and the effect this organic compost process would have on the structural integrity and safety of the buildings on the Pennhurst grounds.
The Applicant addressed the residents' concerns and made note that both the Environmental Protection Agency and the Department of Environmental Protection both support "green business" which includes organic composting. Composting is not a mulching operation. The goal is to keep organic material out of the landfills and put these organic materials to good use in the region. The DEP also has no problem with this site being used for the operation. Although this would be a commercial operation, residents would be notified of days when they can bring their yard waste to the site and may return to purchase the organic compost for their own use. The Applicant is also willing to make substantive changes to the DEP's definition of composting to alleviate some concerns residents may have.
John Hoekstra, member of the East Vincent Environmental Advisory Board (EAC) said the EAC was overly supportive of the idea. Mr. Hoekstra stated that the use of Static Pile Aeration, the method proposed by the Applicant, has been proven successful in creating compost and controlling the smell. He expressed some concern over the use of animal waste, and said "this can be tricky but can be done."
Another resident requested a traffic study be completed on Brown Drive and Old Schuylkill Road in light of the possibility of this compost operation. (Supervisor Dunphy was thanked by this resident for taking her concerns to the police and sending Chief Demski out to see her. Chief Demski and Darwin Schaeffer will work on resolving issues affecting the traffic in that area.)
The Applicant made it clear that the DEP takes an active stance in regulating composting sites. The Applicant MUST operate the business in accordance with the DEP.
A multi-municipal consistency review involving the Phoenixville Regional Planning Committee and the Northern Federation Task Force will be compiled and sent to East Vincent Townships' Environmental Advisory Committee for review. A formal letter will then be written by the EAC to best address the protection of our natural areas.
Chief Demski is asking that all residents lock their doors. There was a burglary in a local large development recently while the family slept. The "cat burglar" often enters the home between 3-5 a.m. Anyone seeing suspicious activity, especially at these hours, should contact the police immediately. Also, it is the season for "Click It or Ticket." Buckle up!
Paul Bucco returned to the Board of Supervisors' last evening to put in an application to allow for independent units in the Light Residential district. The ordinance presently allows for nursing and assisted living facilities in the LR district. Mr. Bucco would like this amendment for use on the Ruth tract. The Ruth Tract is located on Stoney Run Road across from Kolb's meat store.

In an issue separate from the organic composting operation, the owner of the Pennhurst property mentioned that when he settled with the Commonwealth of Pennsylvania, he made land available to the township. He stated that the left portion of Pennhurst is to be dedicated to the township. Mrs. Christine McNeil made it publicly clear that she and Chairman John Funk convinced Sen. Dinniman to provide the township with that land. Mrs. McNeil and Mr. Funk together met with Sen. Dinniman to get him to commit to following through with giving the township the 79.521+/- acres.

Chairman Funk and Vice-Chair McNeil both agreed to spend another $7,000 in taxpayer dollars on the Parker Ford Tavern renovation. Mrs. McNeil said we could get the money by asking the Historical Commission to give $3,000 from their budget and the other $4,000 can come from somewhere in the township budget. One resident asked why if revenues are down why are we spending more money on the tavern? The resident also asked if the $220,000 budget for the Parker Ford Tavern included the $23,000 spent on the architect. Vice-Chair McNeil said "yes." The Informed East Vincent Residents do not believe this is an honest response. Mr. Funk stated that $7,000 is not a lot of money, although he understands it's taxpayer dollars. He also felt that in order to produce a more authentic restoration, it is important to spend more money to cut into the wood (scarfing) than to cover the authentic wood by "scabbing." Supervisor Dunphy, who voted "no" to authorizing more money for this restoration on the basis that the Parker Ford Tavern should be in the hands of a private entity (a 501 C 3, for example) so the taxpayer isn't burdened with the cost, asked why no contingency was put in place. Vice-Chair McNeil stated that when dealing with a restoration things change under the process of discovery. Supervisor Dunphy feels that the Architect Frens and Frens should be responsible for paying the $7,000 as they did the original assessment and should have added in a contingency for such situations.
Another resident stated that with the downturn in the economy, people losing their jobs and a tightening budget, the symbolism of spending more money on this historic restoration is the issue. He also made it clear that any money from the Historic Commissions' budget is money taken from the East Vincent Township taxpayer. Money taken from the budget is taxpayer dollars. Finally, another resident reminded Chairman Funk the he vowed to NEVER use anymore taxpayer dollars on the Parker Ford Tavern and now he has reversed course. She would like to know at what point will taxpayer dollars stop being put into this building.

Any resident, whether democrat or republican, should question why any candidate would provide financial backing for the opposing candidate. Elaine Milito, the Democratic candidate, sent an e-mail from CCOEV to the residents about the upcoming elections. What residents need to know is Elaine Milito and CCOEV are at the same time providing financial backing for the Elaine Husted website. They are both members of the CCOEV and share the same goals and future vision for this township. Elaine Husted and Elaine Milito seem to be making sure their agenda is fulfilled by both campaigning for the same seat on the Board of Supervisors and with financial backing from the group to which they belong.

The Informed East Vincent Residents group accept no donations, gifts or otherwise. We are a non-partisan independent group made up of busy moms, dads, seniors, doctors, financial analysts, computer programmers and more who reside on BOTH sides of the PECO lines. As a result of past proposals considered by some of our Board of Supervisors and Planning Commission officials, we do our best to find time to attend every Board of Supervisors' meeting and Planning Commission meeting, we question our appointed and elected officials when necessary and we take on the challenge of informing our residents through this blog.

Residents should demand transparency and honesty in candidates seeking to hold a position of power. Elaine Husted and/or Elaine Milito will have a vote as our Board of Supervisor on matters which affect all hard working taxpaying residents. Elaine Husted, as demonstrated by this documentation is not a republican running on behalf of other republicans or in the best interest of the township, but is campaigning for, and in collusion with, Elaine Milito (the Democratic candidate) to fulfill their vision of the future outlook for our township. We wonder if this future will include spending more taxpayer dollars to restore an eligible historic building while roads in our township are in desperate need of repair or while our police force is being stretched thin.
It seems to those of us in the Informed East Vincent Residents group that Elaine Husted, the non-endorsed Republican candidate is running only to help Elaine Milito, the Democratic candidate, remove the endorsed Republican candidate, Supervisor Mark Dunphy, from the ticket in the Primary election being held Tuesday, May 19.

What other reason is there to financially support the opposition's candidacy?

Is this the type of behavior we expect from a potential Board of Supervisor? Is this governmental transparency? Can we trust either Mrs.Husted or Mrs.Miltio to make decisions based on the good of the whole township if they are manipulating the system even before they have been elected? These are issues to consider before choosing your candidate. The elected Board of Supervisor will be voting on issues and proposals that will directly affect your safety, health and welfare. Choose wisely. We believe residents of this township deserve better.

Update: East Vincent Township Board of Supervisor's Meeting April 1, 2009

Last evening at the meeting of the Board of Supervisors, Tom Flanagan, president of Volunteer Financial Services, speaking on behalf of the Ridge Fire Company, approached the Board to discuss East Vincent Township's financial contributions in 2010 and beyond. The Ridge Fire Company is requesting additional funding because their equipment (which includes the pumper trucks, pumper tanker and rescue vehicle) is outdated and in need of replacement. The Ridge Fire Company would also like to put an addition onto their existing building. Additional funding is also necessary to help with the cost of the mandated 200-300 hours of accreditation for each volunteer firefighter. No decision was made at this time but Mr. Dunphy did ask Mr. Flanagan if Ridge Fire Company generates any revenue from other sources.

Vice-Chair McNeil would like to have East Vincent Township Planner; Ray Ott, create a Master Plan for the Parker Ford area of the Schuylkill Valley Heritage Trail. The Northern Federation, East Coventry and East Vincent would all contribute financially towards Mr. Ott's service. Supervisor Dunphy questioned why East Vincent Township would pay for another Master Plan if East Vincent Township, as part of the Northern Federation, has already paid for a Master Plan through the Northern Federation Plan. Vice-Chair McNeil replied that now we need a more "detailed" plan to work parallel to the Northern Federation Trail Plan over the next few years. Vice-Chair McNeil stated there are funding sources available.

East Vincent Township has officially begun it's role as "lead municipality" for the Northern Federation. Charles Jacob and Vice-Chair Christine McNeil; both chairpersons for the Northern Federation, wrote the Department of Conservation and Natural Resources (DCNR) and informed the DCNR that East Vincent Township has agreed to be the lead municipality. The first direct deposit is a $26,000 grant acquired by Senator Dinniman. Supervisor Mark Dunphy restated that before the supervisors move forward with Resolution #09-04-01-03 DCNR Other Park Grants for $26,000 for Northern Federation, documentation stating that ALL 9 MUNICIPALITIES of the Northern Federation will agree to pay their share of the $94,000 East Vincent Township has agreed to front, be drawn up and signed by each of the 9 municipalities. Presently, all 9 municipalities have only agreed to contribute $1,000 in 2009 and $1,000 in 2010 to the Northern Federation. Supervisor Mark Dunphy also read from the Northern Federation Minutes of Feb. 10. In the event one or more municipalities do not agree with the Northern Federation Plan, East Vincent Township as the lead municipality will end up being the enforcer, seeking out the municipality to convince the municipality to adopt the plan. East Vincent Township will still be responsible for the financial gap caused by the municipality that chose not to adopt the plan. Vice-Chair McNeil is not concerned and feels that her efforts with Senator Dinniman, and Mr. Paravis' efforts with Senator Rafferty, will yield the monies the Northern Federation is seeking. However, no grant money will be forthcoming unless ALL 9 MUNICIPALITIES AGREE to the plan. Supervisor Mark Dunphy reiterated that East Vincent Township could be on the hook for all $94,000 if all municipalities choose not to participate. A resident asked what if Supervisor Mark Dunphy is right and Vice-Chair McNeil is wrong. Chairman Funk made it clear that East Vincent Township will have to "bare the consequences." "Whether the risk is perceived or real, the township is moving forward with being the lead municipality," Chairman Funk also stated. Chairman Funk and Vice-Chair McNeil, knowing the risk, approved Resolution #09-04-01-03 DCNR Other Parks Grant for $26,000 for Northern Federation. Supervisor Mark Dunphy did NOT approve this resolution knowing that the taxpayers of East Vincent Township could potentially be liable for any additional money due to the plan not being adopted by one or more of the 9 municipalities.

Congratulations to Darwin Schaefer, his crew and all involved for receiving the first ever "Trailblazer Road and Bridge Safety Award," created by the Pennsylvania Highway Information Association. Supervisor Mark Dunphy will accept the award on behalf of East Vincent Township.

The Planning Commission meeting is scheduled for April 21, 2009 at 7:00 p.m. Vice-Chair McNeil stated the Act 537 Plan will be shared and Jim McMaster may present the Phoenixville Regional Plan perspective. A date for the resident subcommittee to work with the Planning Commission on the zoning revision may be suggested at this meeting. Those residents who have contacted the blog requesting to be part of the subcommittee; which was welcomed by the Planning Commission on Feb. 18, should plan on attending this meeting.

Update: Planning Commission Meeting, March 17, 2009

East Vincent Township Planner, Mr. Ray Ott, continued the discussion on the use of Transfer of Development Rights (TDR) to preserve lands in the Agricultural Preservation (AP) and Rural Conservation (RC) districts, with the residents.

Residents directly affected by an increase in housing density in their neighborhood spoke out against the use of TDR's which are used as a tool to allow preservation of land south of the power lines while transferring all major residential density to the northern side of the power lines. Residents questioned why this is being considered. Mr. Ott continued to comment how the Open Space Design Option of the 2002 Ordinance encourages developers to build on the AP and RC lands. Mr. Ott continued to stress that this is not where East Vincent Township wants to see development. Residents who will be impacted by the residential density increase; above and beyond what the initial zoning permitted when they bought their home, feel those who are pursuing this zoning revision (TDR/OSDO Ordinance Amendment) are violating their rights as East Vincent Township taxpaying residents.

One resident asked Mr. Ott where the data is to support the statement that most recent residential development is occurring in the AP and RC districts. This resident stated that as he sees it most development is occurring, or is scheduled to occur, north of the power lines already. Mr. Ott did not have factual data to support his statement.

Another resident, under the impression that the AP and RC districts would be saved from all future development---had the TDR/OSDO Ordinance Amendment been approved, directly asked the members of the Planning Commission present (Michele Adams, Jason Herron, Jeremy Wellen, and Elaine Milito) if Mr. Bucco's land, also known as the Continuing Care Retirement Community (CCRC) land, would come with a guarantee that this land would be saved from all future development. All replied with an adamant "no." There can be no guarantee this land would not be developed even if the TDR/OSDO Ordinance Amendment had been approved, although this land is in the Rural Conservation (RC) district.

Another resident stated that she understands north of the power lines is where growth is to be expected, but to put all of the major residential growth on the northern side isn't right. Traffic is one issue of concern also.

In response to resident input, the Planning Commission, with enthusiastic support from Chair Michele Adams, agreed to a subcommittee of residents to work alongside the Planning Commission to help with the zoning revision. The time and date of this collaborative effort is to be announced.

There were no new proposals brought forth at last evenings Board of Supervisor's meeting.

One resident did request the current burning ordinance for East Vincent Township be updated to include a setback boundary for outdoor burning and also a request that burning after dark be more strictly enforced. The issue at hand is the burning of trash, grass and other objects which prove to be noxious to neighboring residents whose windows are open during the warmer months. Chairman Funk would not like to see the township saddled with more rules and regulations that may burden our police force. Presently, the State of Pennsylvania allows burning between sunrise and sunset. Congratulations to Darwin Schafer and East Vincent Township's Public Works Department; in collaboration with the Environmental Advisory Committee and Green Valleys Association, for receiving a "beyond satisfactory" review from the Department of Environmental Protection (DEP). The DEP review of the annual National Pollutant Discharge Elimination System (NPDES) for East Vincent Township found our township to be "beyond satisfactory" in the maintenance of over 500 inlets and drains throughout East Vincent. Mr. Schafer and the public works department check these inlets and drains after every water event to assure pollutants and other materials don't find their way into our exceptional streams and watersheds. Thank you!

The next evening Board of Supervisor's meeting is scheduled for April 1, 2009 @ 7:30 p.m.

Update on TDR/OSDO Ordinance Amendment Public Workshop Meeting

Last evening, many residents showed up at the Board of Supervisors meeting to learn about the proposed zoning and density changes in East Vincent Township.

One reason East Vincent Township is looking at the present zoning and density change stems from the creation and implementation of the Open Space Design Option (OSDO) in 2002. This OSDO was suggested by the Brandywine Conservancy for the 2002 East Vincent Township Zoning Ordinance and was supported by Planning Commission member, John Funk and East Vincent Township Supervisor, Christine McNeil at the time the 2002 Zoning Ordinance was established. This OSDO does allow for density (in order to preserve open space) in the Agricultural Preservation (AP) and the Rural Conservation (RC) districts and therefore ended up directing development to these areas. The Reiff Tract ruling found that the Open Space Design Option (OSDO) does permit public water and sewer in the AP and RC districts. Public water and sewer can't be legally stopped in the Agricultural Preservation and Rural Conservation districts with an Open Space Design Option.

To address this problem, Mr. Ray Ott attempted to stop all major residential development in the AP and RC districts by utilizing a residential density multiplier. Mr. Ott created receiving areas north of the power lines so the sending areas located in the AP and RC districts would have a place to send the Transfer of Development Rights. The use of the TDR's provides an incentive for builders to move their development out of the AP and RC districts to areas which can receive higher density in the Light, Medium and High Density districts, just as was done previously with the Reiff Tract settlement. The Phoenixville Regional Plan and The Chester County Landscapes 2 Plan also calls for designating growth areas and redirecting growth to those areas deemed appropriate and were also mentioned as reasons for the TDR/OSDO Ordinance Amendment.

The imbalance, however, of shifting all residential development north of the power lines brought residents together. When residents questioned the Planning Commission and Board of Supervisors about this proposed zoning change utilizing a residential density multiplier, Supervisor Dunphy requested a public workshop be held so residents could learn more about the proposed zoning and density change and have an open forum to discuss these proposed changes.

In the months leading up to this public workshop meeting, some of our appointed officials have come to realize they didn't spend enough time investigating these proposed zoning and density changes, and the impact of these changes on our township, and have now decided to revisit the zoning change and start from scratch.

We thank those volunteers on the Planning Commission who have stopped to take another look at the zoning change and who are willing to work with the residents to come up with a zoning ordinance that benefits all of the residents in East Vincent Township and our neighboring townships.

The Transfer of Development Rights/Open Space Design Option Ordinance Amendment (TDR/OSDO) public workshop meeting is being held this Wednesday, February 18 at 7:30 p.m. in the East Vincent Township Municipal Building located at 262 Ridge Road.

The Township has this meeting posted as a "zoning discussion" on the announcement board outside of the township building. Residents concerned about the shift of all major residential development north of the power lines should attend this workshop to voice your concerns and let your supervisors know that everyone in East Vincent Township will be impacted by this shift in residential density. This also includes a bonus residential density of 500+ units. The increase in density will permit town houses, apartments, cluster homes, condominiums, etc. on smaller parcels of land than the present East Vincent Township Zoning Ordinance permits. Residents on Buckwalter Road, just one example, will see a dramatic shift in residential density in their neighborhood. The impact of this density increase, or "up zone" will be directly felt by all residents in that vicinity.

The impact of this zoning change, which includes the use of a residential density multiplier to create receiving areas for TDR's, will be felt throughout East Vincent Township. Tax increases to support infrastructure and utilities, increased demand on emergency personnel, possible future storm water issues, traffic congestion throughout the township---and neighboring township roads, and tax increases to support the demand on the Owen J. Roberts School District will result in the event this TDR/OSDO Ordinance Amendment is approved.

The shift of all major residential development to one side of the township may lead to the Owen J. Roberts School District needing to redistrict to accommodate the new student population, a majority of which will be located north of the power lines in East Vincent Township. All Owen J. Robert School District taxpayers will bear the burden of supporting the increase in student population brought about by the adoption of this bonus residential density proposed by the TDR/OSDO Ordinance Amendment.

Those of us in the Informed East Vincent Residents group felt this matter was extremely important and made every effort to inform our residents, along with neighboring township residents, and now we will all have the opportunity to be involved in the discussion to stop the TDR/OSDO Ordinance Amendment.

Update Board of Supervisors Meeting February 4, 2009

The Bid of $212,150 was accepted last evening for the roof and cornice restoration of the Parkerford Tavern. Chairman Funk and Vice-Chair McNeil approved utilizing $130,000 in taxpayer dollars for the roof restoration. East Vincent Township also received a $90.000 grant towards the Parkerford Tavern roof restoration.

East Vincent Township has officially become the "lead municipality" for Northern Federation Grants. The Northern Federation is the largest active planning group in Chester County, and it's goal is to provide regionally consistent recommendations and actions for the identification and protection of the Region's Natural, Historic, Scenic, Agricultural and Recreational Resources. Townships involved in the Northern Federation include East Vincent, East Coventry, East Nantmeal, East Pikeland, North Coventry, South Coventry, Wallace, Warwick and West Vincent. East Vincent Township's role as the "lead municipality" for Northern Federation Grants involves East Vincent Township Taxpayers fronting the money for any grant requests of the Northern Federation by utilizing any funds available in the East Vincent Township budget. Once the grant application is approved and the 247 reviewed, the East Vincent Township Taxpayer will then be reimbursed. Again, Chairman Funk and Vice-Chair McNeil have approved spending more taxpayer dollars on more Northern Federation requests. Out of the nine members of the Northern Federation Region, East Vincent Taxpayers will be solely responsible for fronting the money for any upcoming grants. Northern Federation Chairman, Charles Jacob; East Vincent Township Vice-Chair and East Vincent Township Northern Federation member, Christine McNeil; and East Vincent Township Manager, Ms. Flagg will be the signatories.

Chairman Funk shared his experience observing the SWAT Team. Mr. Funk was impressed with these professionals and believes having a SWAT Team is worthwhile.

Mr. Harry Tucci is now East Vincent Township's new Emergency Management Coordinator. Congratulations Mr. Tucci!

Congratulations to East Vincent Township on the Standard and Poor's Municipal Bond Rating of Double A! This rating, according to Micheal Wolfe of Boenning and Scattergood, is fabulous and quite an achievement for a community of our size.

Congratulations to Mr. Paul Schmidt, East Vincent Township Building Inspector, who was recognized for his dedication in assisting the Spring Hollow Country Club with their recent addition. The owner invited Mr. Schmidt to cut the ribbon celebrating the new addition. Thank you Vice-Chair McNeil for sharing this with the residents in attendance.

Dear Fellow East Vincent Residents and Neighboring Residents,

The Transfer of Development Rights/Open Space Design Option Ordinance Amendment, Residential Density Multiplier Public Workshop Meeting is definitely scheduled for Wednesday, February 18, 2009 at 7:30 p.m. at the East Vincent Township Municipal Building located on 262 Ridge Road, Spring City.

This TDR/OSDO Ordinance Amendment, RDM, will shift all major residential development north of the power lines and will also include bonus residential development--- also shifted north of the power lines. The impact of this TDR/OSDO, RDM Amendment will be felt throughout East Vincent Township and all residents of our township will experience higher taxes in order to support the demand placed upon the Owen J. Roberts School District and to support the increased utility and infrastructure demands. Traffic congestion as a result of this increased residential density will not isolate itself north of the power lines and will creep onto back roads south of the power lines too.

If there is any meeting to attend, let this be the one. Please come out on Wednesday, February 18, 2009 at 7:30 p.m. to voice your concerns about this increased residential density amendment, including the bonus density, all north of the power lines, which will impact all East Vincent Township residents as well as neighboring township residents.

Update Reorganization Meeting and Board of Supervisors Meeting, January 5, 2009

Last evening at the Reorganization Meeting, Mr. John Funk retained his seat as Chairman of the Board of Supervisors, Mrs. McNeil retained her seat as Vice-Chair of the Board of Supervisors and Mr. Dunphy continues as an East Vincent Township Supervisor.

Committee vacancies filled include Dr. Lester Schwartz retaining his seat on the Planning Commission, Mr. Max Maxfield becoming a Zoning Hearing Board member---replacing Dore Dabback, and Mr. Bruce Weinsteiger taking the position of alternate Zoning Board member.

Following the Reorganization Meeting was the Board of Supervisors meeting. The minutes of December 10, 2008 were not adopted due to Vice-Chair McNeil's wanting the Township solicitor's comments about the Reiff Tract acquisition bulletted in the December 10, 2008 minutes. Chairman Funk would like to see the minutes shortened in the future. Supervisor Dunphy would like the tape of the December 10, 2008 meeting used for factual accuracy in regard to this minutes revisal. Supervisor Dunphy also addressed Vice-Chair McNeils mentioning of the 85 acre park during a Public Meeting, which currently is only in Executive Session, after Vice-Chair McNeil brought the park up again at this Public Meeting.

Chairman Funk and Vice-Chair McNeil both approved certifying the Township's support of the Northern Federation application for funds for a Regional Park, Open Space and Recreation Comprehensive Plan. Mr. Dunphy was not in favor of using more of the East Vincent taxpayers' money for this study considering the same study has been completed by the Phoenixville Region Plan and therefore East Vincent taxpayers are paying twice for a redundant study.

During Public Comment the issue of qualifications for East Vincent Township committee persons was raised. Chairman Funk stated that simply being a "resident of East Vincent Township" is qualification in itself. A taxpayer pointed out that there seems to be a pattern of providing positions for those who have contributed to the Chairman and Vice-Chair's campaigns as some positions seated have been filled by persons with less experience than others who have donated their time for the committee position. Another issue raised was funding for the Regional Park should it come into fruition.Vice-Chair McNeil said East Vincent Township would get the money by the Chester County Planning Commission and two Pa. State Senators. When a taxpayer asked what she meant by this, Vice-Chair McNeil responded with "verbal assurances" from two Pa. State Senators but she would not like to provide their names. The money for this Regional Park therefore is not concretely guaranteed at this time. A taxpaying resident stated a "grant" is still coming from the taxpayer and therefore does not mean "free" money.

It is worth noting that East Vincent Police have cameras installed in their vehicles, thanks to a grant from Congressman Gerhlach. An I-Cop Nightscope camera will be in use on one of the police vehicles also.

As of January 1, 2009, the new "Right To Know" law was enacted.This new law gives residents more access to records involving their township. Costs for copying each page will be 25 cents.

The Transfer of Development Rights/Opens Space Design Option Ordinance Amendment, Residential Density Multiplier (RDM Proposal) will definitely occur in February at a soon to be announced evening workshop meeting. It is relevant for those concerned about the impact of adding additional density to our Township attend this workshop meeting. Please share this information and site with your neighbors and check regularly for updates in regard to this density change. This density includes a bonus density of 500+ units.

Update to December 10, 2008 East Vincent Board of Supervisors Meeting

The Public Hearing on the Reiff Tract parkland acquisition, was held last evening during the Board of Supervisors meeting. Several concerns about access to this Reiff Tract park were raised.

The blueprint for the Reiff Tract parkland presented last evening to the residents showed access to the park directly off Ridge Road between several established residences. Another point of access which had been presented to the Board of Supervisors in November 2007, showed access through the East Vincent Elementary School grounds. The East Vincent Township Open Space and Recreation Plan adopted October 17, 2007 states "36 acres of the Reiff Tract that the Township has negotiated to purchase with State grant funds, for use as a passive use, interpretive park." The DCNR website clearly states "The new Township Park is central to the Township and will provide extensive outdoor recreation facilities-both passive and active-and trails through the park that will connect to the adjacent Vincent Elementary School and link to other parts of the township. The large natural area to be preserved will afford residents and visitors educational opportunities to study wildlife habitats, stream studies, as well as hiking and fishing."

One resident expressed safety concerns for the students and staff of the East Vincent Elementary School if access were permitted utilizing elementary school grounds. This resident requested our supervisors follow the lead of East Pikeland Township and the Phoenixville School District which made access to their trail accessible for the public by moving the trail away from students of the proposed Kimberton Elementary School. Another resident who will be directly affected if access is permitted between his and his neighbor's established property also spoke about his concerns.

Chairman Funk made it clear these access points are only options and have not yet been resolved. Supervisor Dunphy stated he wants what is best for the entire Township and the Reiff Tract park, with the issues of access, population data and the financial obligation it cost the Township to purchase this parcel, does not appear to benefit the entire Township. Mr. Dunphy made it clear he was glad the 72 homes were not built, but felt this Reiff Tract purchase could have been better handled. Pam Brown, Director of the French and Pickering Creek Trust shared with the Board there must be public access if the Township receives public money.

The Transfer of Development Rights/Open Space Design Option Ordinance Amendment (Residential Density Multiplier) was not discussed at last evening's meeting but we will be sure to keep our residents informed of the date and time of the evening workshop meeting.

The reorganization meeting of the Board of Supervisors will be held on Monday, January 5, 2009 immediately followed by the regular Board of Supervisors meeting.

Update Board of Supervisors meeting November 6,2008

The next Board of Supervisors meeting has been rescheduled for Wednesday, December 10, 2008 at 7:30 p.m.

A Public Hearing will be held during this December 10, 2008 Board meeting in regard to the announcement of the Reiff Tract Settlement and Resolution 08-11-05-02.

This announcement led to questions by certain taxpaying residents in regard to access to the 36.5 acre park acquired by East Vincent Township as a result of the Reiff Tract settlement. Presently,there is no clear answer as to how the residents will access this park. The Township solicitor, Mr. Cohen did state there was "legal access" to the park using Ridge Road.

In regard to the evening workshop meeting, dedicated exclusively for discussion of the TDR OSDO Ordinance Amendment (RDM Proposal), a February 2009 meeting date has been suggested. We will notify our residents when there is a date and time certain.

Update: Board of Supervisors Meeting Sept. 18,2008

Last evening Supervisor Mark Dunphy asked his fellow Board members why this particular meeting was scheduled and why it is being held in the evening. The Board of Supervisors had rescheduled the next evening meeting for Oct. 8, 2008, so Mr. Dunphy wanted a clear explanation as to why everyone was gathered at this meeting tonight on Sept. 17. No strong reasons were provided by Supervisors Mr. Funk and Mrs. McNeil and no issues on the agenda seemed to be of an urgent nature. It is still unclear why this meeting was held.

Two weeks ago, at the Sept. 3, 2008 BOS meeting, residents were told there was no action on the "TDR and Open Space Design Ordinance Amendments" (Residential Density Multiplier proposal). The Sept. 17, 2008 agenda clearly lists one of the items as the "TDR and Open Space Design Ordinance Amendments." Residents had also been advised that if an ordinance was created, a workshop meeting dedicated exclusively to going over the reasons for the ordinance would be publicized and public input would be welcome. What actually transpired is the TDR Ordinance was placed on the draft agenda (line item 5a), for an originally nonscheduled meeting (Sept. 17, 2008) and without the workshop meeting for the residents of East Vincent.

An East Vincent taxpaying citizen, taking notice of the sudden appearance of the "TDR and Open Space Design Ordinance Amendments" on the agenda, wrote to the Board earlier in the day to express dissatisfaction that this Ordinance was suddenly on the agenda. This taxpaying resident asked the Board if they had received the letter. Mr. Funk called the letter "inflammatory" and did not appreciate the tone of the letter. Mr. Funk said the TDR Ordinance was not going to be discussed and a heated argument ensued. The taxpaying resident again asked for clarification as to why this evening meeting was scheduled. This taxpaying resident also asked why this BOS meeting was not more aggressively publicized as was the Historic Commission's Open House and Art Show. More questions followed and Mr. Funk would not answer any questions. Chairman Funk gavelled the taxpaying citizen and called in local law enforcement to have the individual escorted from the meeting. This taxpaying resident voluntarily left the meeting but with none of the questions entertained.

A workshop meeting date has yet to be decided upon but may occur in November. It is absolutely imperative that residents who would like to see their rural quality of life continue, regardless of which side of the power lines you may reside, attend the "TDR and Open Space Design Ordinance Amendment" workshop (RDM proposal). We understand families are busy and those of us who attend the East Vincent Township meetings regularly can truly appreciate how difficult it can be to attend, but if there is any meeting to attend, it will be the "TDR and Open Space Design Ordinance Amendment" workshop (RDM proposal). Attending this workshop will give you a voice as crucial changes to our township's zoning are being decided upon which will deeply impact all of East Vincent Township.

We will contact our East Vincent Township residents, as well as other neighboring residents who will be affected by this zoning amendment, when we learn of the scheduled meeting date and time for the "TDR and Open Space Design Ordinance Amendments" (Residential Density Multiplier) workshop.

Board of Supervisors Meeting Wednesday, Sept. 17, 2008 at 7:30 p.m.

The East Vincent Board of Supervisors has changed the meeting time from 8:30 a.m. to 7:30 p.m. this evening, Wednesday. Sept. 17, 2008.

The Draft Agenda contains TDR and Open Space Design Ordinance Amendments (5a). The TDR item will be presented to allow for a meeting to be scheduled to discuss the TDR Residential Density Multiplier Ordinance. No discussion will take place at this time.

The Informed East Vincent Residents group will promptly notify residents when this discussion is scheduled.

Board of Supervisors Meeting Update, September 3, 2008

Last evening, an East Vincent Township resident asked the Board about the status of the Residential Density Multiplier proposal (RDM). Mr. John Funk, chairman of the board, informed the residents in attendance that the RDM is still a proposal and there is not an RDM Ordinance established at this time.

A Board of Supervisors meeting is scheduled for this Wednesday, Sept. 3 at 7:30 p.m. in the East Vincent Township Municipal building located at 262 Ridge Rd.

The Residential Density Multiplier (RDM) is not currently on the agenda. The Informed East Vincent Residents group will continue to monitor any activity which involves the RDM proposal and will notify East Vincent residents should the workshop meeting be announced.

Board of Supervisors Meeting Update

Last evening, residents took advantage of the opportunity to ask two of our Board of Supervisors, Mrs. McNeil and Mr.Dunphy (Mr. Funk was not present) questions regarding the Residential Density Multiplier analysis and what effect this may have on our community. We were informed that the proposal is still being crafted and when it is complete, a workshop meeting will be held allowing all residents to attend. This workshop meeting, to be announced, will provide an open forum to discuss the Residential Density Multiplier at length and will also allow resident's voices and concerns to be heard.

Our supervisors did not deny the residential density increase (upzoning) on the northern side of Rt. 23 and Mrs. McNeil made mention of the Chester County Landscapes 2 Plan as one reason for the use of the Residential Density Multiplier. Don't Let East Vincent Officials Change Our Rural Quality of Life

At the July 15, 2008 meeting of the Planning Commission, Mr. Ray Ott presented an analysis of a "Proposed Residential Density Multiplier” which will have real monetary effects for our citizens, along with other pertinent issues. We believe that the impact of this proposed residential density multiplier will be felt throughout the entire township, but north of Rt. 23 will especially feel the brunt of the result of this proposal. This impact will not only include an increased residential density and bonus residential density north of RT. 23, but also traffic congestion throughout our township and neighboring townships, tax increases to support the increased demand on the Owen J. Roberts School District, increased infrastructure and utility demands, possible future storm water management issues, and irreversible changes in our rural character (as this proposal includes more high density housing such as townhouses, apartments, cluster housing, etc.). Residences north of Rt. 23 will be hardest hit with lowering property values, traffic congestion, noise and additional lighting from the street lamps, residential lighting and headlights. Construction work during this build out will also heavily impact all residents quality of life within this up zoned area.

The proposed Residential Density Multiplier was presented to demonstrate how the transfer of development rights (TDR) would benefit preservation of open space within East Vincent Township. TDR’s are defined by The Field Guide to Transfer Of Development Rights (TDRs), Updated March 2007, as the following: “TDR is the exchange of zoning privileges from areas with low population needs, such as farmland, to areas of high population needs, such as downtown areas.”

East Vincent Township’s TDR Ordinance defines Transferable development rights (TDRs) as attaching of development rights to specified lands which are desired by the Township to be kept undeveloped, but permitting those rights to be transferred from those lands so that the development potential which they represent may occur on other lands within the Township where more intensive development is deemed by the Township to be appropriate.

In other words, all future major residential development is being shifted from south of Rt. 23 to north of Rt. 23 in East Vincent Township.

The Open Space Design Option (OSDO), in the East Vincent Zoning Ordinance (Part 9) allows for higher density development in order to preserve open space through the use of TDR’s.

Presently, our residential zoning districts consist of Agricultural Preservation (AP), Rural Conservation (RC), Light Density Residential (LR), Medium Density Residential (MR) and High Density Residential (HR).

This RDM proposal-using a third residential density multiplier, increases the build out units from 1,021 to 1,506. Not only will the build out density increase on the northern side of Rt. 23, but those residents will experience a bonus density of almost 500 units, a 48% increase in density from the existing plan.

Mr. Ray Ott, EVT Planner, has created more receiving areas north of Rt. 23. These receiving areas are located in the LR/MR/HR districts north of Rt. 23, with the highest density located in the vicinities of Buckwalter Road and Stoney Run Road and across Old Schuylkill Road along Brown Drive. Other lands are also slated for increased density.

We understand that the corridor of Route 724 is slated for commercial and light industrial development. In addition to the development of the Rt.724 corridor, does our township need to adopt this large of a density multiplier that will create an enormous receiving area for TDR’s north of Rt. 23 only?

Some questions that need to be raised to the board of supervisors include:

Can we afford to allow our quality of life to deteriorate through this residential density and bonus density up zoning?
Should we be expected to handle the tax burden that will occur to support lands that we are not even able to use?
Why is the density multiplier so high? Do we truly need a density multiplier?
Have they considered the long-term effects of adding so much density to the township? (i.e. increase in property taxes, changes to our rural community north of route 23,traffic congestion-noise, etc.)
Has an analysis been completed which would show the effects of increased traffic, water usage, sewage needs and utility, needs, etc.?
What will be done to make our roads more compatible with the increase in traffic?
Who will pay for these improvements?

The next Board of Supervisor’s meeting is scheduled for Tuesday, August 12 at 7:30 p.m. This will be an opportunity to ask our supervisors about our Open Space Design Option and Residential Density Multiplier. If we don’t stop this ordinance now, what doors will it open on land use and zoning in the future?
